General Terms and Conditions of Sale
Artist Residency Platform – Jardin Musical

1. Purpose
These General Terms and Conditions of Sale (hereinafter the "GTC") define the terms under which the Jardin Musical platform (hereinafter the "Platform") enables professional or private users (hereinafter the "User" or the "Artist") to:
- create a personal account
- join the Jardin Musical artistic residency ecosystem
- purchase credits
- book studio time slots
- book associated services (sound and/or video engineer, piano tuning, accommodation, private concert, etc.)
2. Identity of the Service Provider
The Platform is operated by:

3. Access to the Platform
Access to the Platform is reserved for persons who:
- are of legal age
- have full legal capacity
- have created a valid user account
- have accepted without reservation the Terms of Use and these GTC
Jardin Musical reserves the right to refuse or suspend access to any account in the event of non-compliance with the Terms of Use or these GTC.
4. Account Creation
Creating an account is mandatory in order to access the services. The User undertakes to:
- provide accurate and up-to-date information
- maintain the confidentiality of login credentials
- assume full responsibility for all actions carried out through their account
5. Description of Services
The Platform notably enables:
- booking of studio time at Jardin Musical
- booking of technical services (sound engineer, video engineer)
- booking of piano tuning
- booking of overnight accommodation at Jardin Musical
- booking of time slots for private concerts or events
- access to audiovisual autonomy training sessions
- management of credits and booking history
Services are provided subject to availability as indicated in the schedule.
6. Credit System
6.1 Principle
Services offered on the Platform are accessible through a system of credits purchased in advance. Each service corresponds to a specified number of credits displayed on the Platform.
6.2 Purchase of Credits
Credits are purchased via the Platform according to the applicable pricing. Payments are due immediately. Credits are credited to the user account once payment has been validated.
6.3 Validity of Credits
Unless otherwise specified, credits are:
- non-refundable
- non-exchangeable for cash
- valid for a defined period indicated at the time of purchase
7. Bookings
7.1 Terms
Bookings are made exclusively via the Platform, subject to availability of time slots and sufficient credit balance. Any confirmed booking results in the immediate deduction of the corresponding credits.
7.2 Modification and Cancellation
Conditions for modification or cancellation are specified at the time of booking. In the event of late cancellation or failure to attend, credits may be partially or totally forfeited, except in cases of duly justified force majeure.
8. User Obligations
The User undertakes to:
- respect the premises, equipment, and facilities
- use the studio in accordance with the communicated rules
- respect reserved time slots
- assume responsibility for any damage caused by themselves or their collaborators
Repair or replacement costs may be charged in the event of damage.
9. Liability
Jardin Musical shall not be held liable for:
- loss of the User's personal data
- the artistic or commercial quality of productions created
- damages resulting from improper use of equipment
- damage to equipment caused by other Users
- any impediment resulting from force majeure
10. Intellectual Property
Works, recordings, and content produced by the User within the residency remain the exclusive property of the User, unless otherwise agreed in writing. Jardin Musical claims no exploitation rights without explicit consent.
11. Personal Data
Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the Platform's Privacy Policy. Users have the right to access, rectify, and delete their personal data.
12. Suspension / Termination
Jardin Musical reserves the right to:
- suspend or terminate an account in the event of serious breach of these GTC
- block access to services without compensation in cases of abusive use
13. Modification of the GTC
These GTC may be modified at any time. The applicable version is the one in force at the time the service is used.
14. Governing Law and Jurisdiction
These GTC are governed by Belgian law. Any dispute shall fall under the exclusive jurisdiction of the courts of Brussels, unless mandatory legal provisions provide otherwise.
