General Terms of Use

These General Terms of Use (hereinafter the "GTU") define the terms and conditions governing access to and use of the Jardin Musical artist residency platform (hereinafter the "Platform"). They govern the rights and obligations of users in relation to:

• the creation and management of a user account
• access to booking functionalities
• use of the tools provided
• participation in the Jardin Musical community

The Platform is a digital service (web and mobile) enabling artists, creators, and cultural professionals to:

• join the Jardin Musical residency ecosystem
• manage studio and service bookings
• monitor their credits and activities
• collaborate within a respectful and shared artistic framework

Access to the Platform is reserved for persons who:

• are at least 18 years old
• have full legal capacity
• have accepted these GTU and the General Terms of Sale (GTS) without reservation

Certain functionalities may be subject to:

• validation of the account by the Jardin Musical team
• participation in prior training
• purchase of credits

The User undertakes to use the Platform:

• in strict compliance with applicable laws
• with respect for individuals, works, and premises
• in accordance with the cooperative and benevolent spirit of Jardin Musical

In particular, it is strictly prohibited to:

• use the Platform for fraudulent or abusive purposes
• disrupt the technical operation of the service
• compromise the security or integrity of the Platform
• disseminate illegal, defamatory, or discriminatory content

The User undertakes to:

• respect the premises, equipment, and materials provided
• use the facilities in accordance with communicated instructions
• comply with reserved schedules

Any damage, misuse, or breach of rules may result in:

• additional charges
• temporary or permanent suspension of access to the Platform

The Platform aims to create a collaborative ecosystem. By using the Platform, Users agree to contribute to this objective.

• adopt a respectful attitude toward other members
• encourage mutual support, knowledge sharing, and transmission
• respect the diversity of artistic and cultural backgrounds

Any behavior contrary to these principles may lead to disciplinary measures.

Users' personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the Platform's Privacy Policy. Users have the right to access, rectify, restrict, and delete their data.

Jardin Musical endeavors to ensure continuous access to the Platform but does not guarantee uninterrupted availability. Temporary interruptions may occur due to:

• maintenance
• updates
• technical or security reasons

No compensation may be claimed on this basis.

Jardin Musical shall not be held liable for:

• damages resulting from improper use of the Platform
• losses or damages related to Users' artistic activities
• temporary service interruptions
• contractual relations between Users
• unforeseeable technical issues beyond the Platform's control

Jardin Musical reserves the right to:

• suspend or delete an account in the event of non-compliance with the GTU
• restrict access to certain functionalities without prior notice in cases of serious abuse

Users may request deletion of their account at any time.

These GTU may be modified at any time. Users will be informed of any substantial changes. Continued use of the Platform constitutes acceptance of the updated GTU.

These GTU are governed by Belgian law. Any dispute shall fall under the exclusive jurisdiction of the courts of Brussels, unless mandatory legal provisions provide otherwise.
